Some FAQ’s, Answered:

Q1 – Can I change anything once I purchase it?
A1 – Yes, you can change whatever you would like to. Website, audio stream content, etc.

Q2 – What are the running costs?
A2 – Currently it costs around $20 per month in hosting fees. There are aslo the yearly domain fees. Your account comes with a preset amount of bandwidth, If you go over bandwidth then further charges will be incurred. Please ask us if you require more information.

Q3 – Does it require special hosting, can I change hosts?
A3 – The website does not require special hosting but the stream requires shoutcast hosting, this is currently tied to the website.
You can split them but that would involve some work obviously. Please contact me if you need clarification.
Yes, if you desire you can change hosts. Though the current hosts offer excellent value for money and excellent reliability.

Q4 – Can I add advertising to the station?
A4 – Yes, you can add audio ads to your station, we can even put you in touch with people for voiceovers, etc. You can also add banner advertising to the website.

TERMS AND CONDITIONS

We try our best to please and offer you the best service at the best price, however there are some terms and condition and some notes below:
This sale is for our time in the setting up of accounts with a third party hosting company, the setup of your website on that third party hosting companies servers, the setup of your shoutcast audio stream on that third party hosting companies servers, the uploading of our music package to that third party shoutcast audio stream FTP server and the submission of your shoutcast MP3 based audio stream to the directories as shown. We will not be held liable should any problems arise with any third party or their services to you.
We pre-load music from various sources that allow royalty free playouts of their tracks. You may upload and play copyrighted tracks but YOU must organise the correct rights and pay the correct royalties. It is always YOUR responsibility to ensure your station is broadcasting within the applicable laws and paying the correct royalties, should any be required.
You can have your own logo added to your website. We require this supplied within 48 hours of the sale. We will not be held liable for any delays in logos being provided by yourself.
Time is required to order and setup your site after purchase, we do all we can to do this as quickly as possible. We cannot guarantee to provide service within a specific amount of time.
We will submit your station to a number of directories. Submission to these directories does not guarantee acceptance. We make no guarantee that you station will be listed.
The playing of music in public spaces will require the correct licences and permits. These are not included with your station. Please seek advice from your local authority or the PRS.
We require payment to clear before work can commence on your site due to the bespoke nature of this work.

General terms and conditions:
The first £50 of your payment is an account setup charge and is non-refundable.If a refund is granted all properties including logos, domain names, websites, etc return to our ownership. In the case where a domain is moved to another registrar or server and the setup charge is subject to a refund or chargeback, the full amount of the sale will be come due immediately.
We reserve the right to change our terms and conditions at any time. Please email us for a copy of our latest terms and conditions.
1. Generic Server does not back up Your data/website and whilst every attempt would be made in the unlikely event of any corruption or hardware failure, Generic Server cannot guarantee to be able to replace lost data. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Generic Server and its employees.
2. Generic Server makes no warranties or representations that any service will be uninterrupted or error-free. You accept all services provided hereunder “as is” without warranty of any kind.
3. All implied conditions, warranties and terms (whether express or implied by statute, common law, custom or otherwise) including, but not limited to, those relating to the exercise of reasonable care and skill, fitness for purpose and satisfactory quality (where applicable) are hereby excluded in relation to each of the services to be provided hereunder to the fullest extent permitted by law.
4. Generic Server shall not be liable for any services or products to be supplied by any third party.
5. Generic Server shall not be liable for any loss or damage of whatsoever nature suffered by You arising out of or in connection with any breach of this Agreement by You or any act, misrepresentation, error or omission made by You or on Your behalf.
6. Generic Server will not be liable for any indirect loss, consequential loss, loss of profit, revenue, data or goodwill howsoever arising suffered by You or for any wasted management time or failure to make anticipated savings or liability You incur to any third party arising in any way in connection with this Agreement or otherwise whether or not such loss has been discussed by the parties pre-contract or for any account for profit, costs or expenses arising from such damage or loss.
7. No matter how many claims are made and whatever the basis of such claims, Generic Server’ maximum aggregate liability to You under or in connection with this Agreement in respect of any direct loss (or any other loss to the extent that such loss is not excluded by other provisions in this Agreement) whether such claim arises in contract or in tort shall not exceed a sum equal to the fees paid by You for the services in relation to which Your claim arises during the 12 month period prior to such claim.
8. None of the clauses herein shall apply so as to restrict liability for death or personal injury resulting from the negligence of Generic Server, its employees or its sub-contractors.
9. Generic Server shall not be liable for any interruptions to the services or outages arising directly or indirectly from:-

I. interruptions to the flow of data to or from the internet;
II. changes, updates or repairs to the network or software which it uses as a platform to provide the services;
III. the effects of the failure or interruption of services provided by third parties;
IV. factors outside of Generic Server’ reasonable control;
V. Your actions or omissions (including, without limitation, breach of Your obligations set out in the Agreement) or those of any third parties;
VI. Problems with Your equipment and/or third party equipment;
VII. Interruptions to the services requested by You.

Server use
Generic Server reserves the right to refuse service and/or access to its servers and/or services to anyone.
Generic Server does not allow any of the following content to be stored on its servers:
Adult material – includes all pornography, erotic images, or otherwise lewd or obscene content.
Excessive download content or non-linked content.
Refusal of service based on content matching either of these two criteria is entirely at the discretion of Generic Server.
Generic Server reserves the right to move your data to a different server with no previous notice.
Support
We will endeavour to provide a continuous high quality service. If you experience problems with your service, you should consult us via our support email address.
Please note we may require suspension of some of our services for short scheduled periods to carry out maintenance or repair to our services.
Refunds
Fees charged on a pre-pay basis (together with account set-up fees, where applicable), are non-refundable.
Customers will only be entitled to a refund when the service is cancelled by Generic Server.
If a customer contravenes Generic Server’ Terms of Service a refund may not be issued in the event of a cancellation.
Any customer withdrawing payments via bank or credit card (a “chargeback”) may be subject to a punitive fee of £50, should the company deem this chargeback to be unfair. The company also reserves its right to defend such chargebacks and recover the original monies from the customer.
